Terms of Service
Draft dated October 17, 2026
These Terms govern access to PROPERTY OS (the “Service”) provided by [COMPANY LEGAL NAME] (“we”, “us”). By creating an account you agree to these Terms on behalf of yourself and the organization you represent.
1. Nature of the Service
The Service compiles information from public government datasets (including NYC Open Data) and information supplied by customers, and provides analysis and workflow tools. Public data may be incomplete, delayed or inaccurate. The Service does not provide legal, engineering or financial advice, and nothing in the Service — including risk assessments, exposure estimates, AI-generated content or Property Passport reports — is an official government determination, a compliance certificate, or a guarantee that a property is free of violations.
2. Accounts and organizations
- You must provide accurate information and keep credentials confidential.
- Organization administrators control membership and access to organization data.
- You are responsible for activity under your account.
3. Acceptable use
- Use Distress Radar information only for lawful business purposes and comply with all applicable outreach laws (including the TCPA, CAN-SPAM, and NYC consumer-protection rules), do-not-contact requests and fair-housing obligations.
- Do not attempt to identify, contact or harass tenants or other private individuals using the Service.
- Do not scrape, reverse engineer, overload, or circumvent access controls of the Service or of any government data source.
4. Contractors and quotes
We facilitate introductions and proposals between owners and contractors but are not a party to any contract between them. A “verified” badge reflects our review of submitted documentation at a point in time; owners remain responsible for their own due diligence.
5. Fees and billing
Subscriptions renew monthly until cancelled. Fees are processed by Stripe. Plan limits (e.g. buildings, ZIP codes) apply as described at purchase. [Refund policy to be determined.]
6. Customer content
You retain rights to documents and information you upload and grant us a license to host and process them to provide the Service. You represent you have the right to upload them.
7. Disclaimers and limitation of liability
[To be drafted by counsel, including disclaimer of warranties, limitation of liability, and indemnification.]
8. Termination
You may delete your account at any time. We may suspend accounts that violate these Terms.
9. Governing law
[State of New York — to be confirmed by counsel.]
10. Contact
